PSYPACT Publishes Proposed Rules for Public Comment
The Psychology Interjurisdictional Compact (PSYPACT) Commission has published Proposed Rules for consideration and comment. The Proposed Rules can be found HERE.
These Proposed Rules are open for a period of 60 days for public comment for those stakeholders interested in providing such comment. The deadline for submission of written comments is October 3, 2023.
Written comments can be submitted via the PSYPACT website and submitted to the PSYPACT Commission no later than 5:00 pm Eastern on October 3, 2023.
A public hearing will be conducted as part of the PSYPACT Commission’s Annual Meeting via Zoom on November 16, 2023, beginning at 11:00 am Eastern. Interested parties may participate and notification will be posted to the PSYPACT website 30 days prior to the meeting with call-in information provided.

NEW PRAXIS EXAM – School Psychologists
A new Praxis School Psychologist exam will be available beginning September 1, 2022 to align with the NASP 2020 Professional Standards.
What does this mean for anyone you know that plans to take the exam?
The current exam (Exam #5402), with a qualifying score of 147, will be available through August 31, 2023.
The new exam (#5403), with a qualifying score of 155, will be available beginning September 1, 2022. In other words, for an entire year from September 1, 2022 through August 31, 2023, individuals will have a choice which version of the exam they wish to take, to accommodate those that have already begun their exam preparation.
Why is the passing score different? Does this mean the exam is more difficult?The Praxis cut score is created using the Angoff method – an expert judgement process that included school psychology professionals from around the country. Each version of the exam, with its own set of questions and unique passing score, can not be directly compared to others. Therefore, a different cut score does not mean the exam has become more difficult. This process was completed by the Educational Testing Service. NASP accepted the recommendation made by ETS.

Psychologist License Issuance Applications Moving Online
As part of the ongoing efforts to improve efficiency within the agency, the Behavioral Health Executive Council (BHEC) is pleased to announce that the “Request To Issue Psychologist License” application will move to the online licensing system on May 22, 2022. A detailed “How-To Guide” and the checklist of required documentation will be published on the BHEC website on May 22nd. Paper versions of the “Request To Issue Psychologist License’ received on or after May 22, 2022 will not be accepted and will be returned to the sender.

Executive Council published adopted rules in 22 TAC Chapter 883
On May 4, 2021, the Texas Behavioral Health Executive Council voted to publish proposed rule changes to Title 22 of the Texas Administrative Code, §883.1 Renewal of a License.
On June 18, 2021, the Council’s proposed rules were published in – then on August 2, due to technical correction, withdrawn from – the Texas Register [46 TexReg 3698]. On August 13, 2021, the Council’s corrected proposed rules were published in the Texas Register [46 TexReg 4973]. Public comment was reviewed by the Council on October 26,, 2021, and the Council adopted rules as proposed.
On November 12, 2021, adopted rules were published in the Texas Register [46 TexReg 7788], effective November 21, 2021. On and after November 21, 2021 these new rules will be available on the Texas Secretary of State’s webpage for 22 TAC Part 41.

The Texas State Board of Examiners of Psychologists published proposed rules regarding 22 TAC, Chapters 463 and 465
On May 13, 2021, the Texas State Board of Examiners of Psychologists (PSY Board) voted to publish proposed changes to Title 22 of the Texas Administrative Code §§463.11 and 465.13, concerning supervised experience required for licensure as a psychologist and personal problems, conflicts and dual relationship, respectively.
On August 24, 2021, the Texas Behavioral Health Executive Council (Council) to publish proposed changes to the above-listed sections.
On October 1, 2021, the Council’s proposed rules were published in the Texas Register [46 TexReg 6468] with call for public comments.

On August 24, 2021, the Texas Behavioral Health Executive Council (Council) voted to publish proposed changes to Title 22 of the Texas Administrative Code §§882.37, 882.70, 884.4 and 885.1, concerning COVID-19 Vaccine Passports Prohibited, Emergency Temporary License, Special Requirements for Complaints Alleging Violations Related to Court-ordered Therapy or Parenting Facilitator Services, and Executive Council Fees, respectively.
On October 1, 2021, the Council’s proposed rules were published in the Texas Register [46 TexReg 6500] with call for public comments.

NEW RULES – 22 TAC CHAPTERS 881, 882, AND 885
EFFECTIVE SEPTEMBER 19, 2021
Executive Council published adopted rules in 22 TAC Chapters 881, 882, and 885
On May 4, 2021, the Texas Behavioral Health Executive Council voted to publish proposed rule changes to Title 22 of the Texas Administrative Code, §§881.21, 882.11, and 885.1, concerning Petition for Rulemaking, Applicants with Foreign Degrees and Executive Council Fees, respectively.
On June 18, 2021, Executive Council’s proposed rules were published in the Texas Register [46 TexReg 3696]. Public comment was reviewed by the Executive Council on August 24, 2021, and the Executive Council adopted rules as proposed.
On September 17, 2021, adopted rules were published in the Texas Register [46 TexReg 6262], effective September 19, 2021. On and after September 19, 2021 these new rules will be available on the Texas Secretary of State’s webpage for 22 TAC Part 41.
Updated Consolidated Rulebooks will soon be available on the Executive Council’s Statutes and Rules webpage.
Subscription to email updates from the Executive Council and the member boards may be entered via the Executive Council’s Email Updates webpage. Members of the public may also sign-up to receive email notification of any rule action taken by the Executive Council as published in the Texas Register via the Texas Secretary of State’s Subscription Formats and Options webpage.

CALL FOR PUBLIC COMMENT ON PSYPACT PROPOSED RULES
The Psychology Interjurisdictional Compact (PSYPACT) Commission has published Proposed Rules for consideration and comment. The Proposed Rules can be found HERE.
These Proposed Rules are open for a period of 60 days for public comment for those stakeholders interested in providing such comment. The deadline for submission of written comments is November 4, 2021.
Written comments should be submitted via the public comment form found on the PSYPACT website (https://psypact.site-ym.com/page/PublicComment) and submitted to the PSYPACT Commission no later than 5:00 pm Eastern on November 4, 2021.
A public hearing will be conducted as part of the PSYPACT Commission’s Annual Meeting via Zoom on November 18, 2021 beginning at 10:00 am Eastern. Interested parties may participate and notification will be posted to the PSYPACT website (https://psypact.site-ym.com/page/Meetings) 30 days prior to the meeting with call-in information provided.

On May 4, 2021, the Texas Behavioral Health Executive Council (Council) voted to publish proposed changes to Title 22 of the Texas Administrative Code §§881.21, 882.11, 883.1, and 885.1, concerning Petition for Rulemaking, Applicants with Foreign Degrees, Renewal of a License, and Executive Council Fees, respectively.
TSBEP recommended and Executive Council published proposed rules regarding 22 TAC, Chapters 463 and 465
On February 11, 2021, the Texas State Board of Examiners of Psychologists (TSBEP) voted to recommend changes to Title 22 of the Texas Administrative Code §463.9, 465.2, and 465.38, relating to licensed specialist in school psychology, supervision, and psychological services for schools, respectively. On May 4, 2021, the Council considered the TSBEP’s recommended changes and voted to approve publication of proposed rules.
On June 18, 2021, the Council’s and TSBEP’s proposed rules were published in the Texas Register [46 TexReg 3671 and 3696].

TSBEP Board recommended and Executive Council published proposed rules regarding 22 TAC, Chapters 463 and 465
On November 19, 2020, the Texas State Board of Examiners of Psychologists (TSBEP) voted to recommend changes to Title 22 of the Texas Administrative Code §§463.10, 463.35, 463.40 (repeal), 463.30 (new), 465.1, 465.2, and 465.13, concerning applications and examinations, and rules of practice, respectively. On January 12, 2021, the Texas Behavioral Health Executive Council (Council) considered the TSBEP’s recommended changes and approved publication of proposed rules.
On February 19, 2021, the Council’s proposed rules were published in the Texas Register [46 TexReg 1177].

TSBEP Social Media and Electronic Communication Guidelines
The mission of the Texas State Board of Examiners of Psychologists (“Board”) is to protect the public by ensuring that psychological services are provided to the people of Texas by qualified and competent practitioners who adhere to established professional standards.
It is with this mission in mind that the Board set out to develop these guidelines for using social media and electronic communications. When developing these guidelines, the Board relied in-part upon stakeholder input and the prior work of ASPPB’s Social Media Taskforce.
TSBEP licensees who choose to use social media in their practice should take precautions to be mindful and remain in compliant with all relevant ethical, professional, and legal responsibilities, in addition to policies and guidelines in Texas.

Executive Council published adopted rules regarding 22 TAC Chapters 881 and 885
On August 28, 2020, the Texas Behavioral Health Executive Council voted to publish proposed rule changes to Title 22 of the Texas Administrative Code, §§881.21 and 885.1, concerning Petition for Rulemaking and Executive Council Fees.
On October 2, 2020, the Executive Council’s proposed rules were published in the Texas Register [45 TexReg 6958]. Public comment was reviewed by the Executive Council on January 12, 2021, and the Executive Council adopted rules as proposed.
On February 5, 2021, adopted rules were published in the Texas Register [46 TexReg 915], effective February 9, 2021. On and after February 9, 2021 these new rules will be available on the Texas Secretary of State’s webpage for 22 TAC Part 41.

Optional COVID-19 Licensure Modification Forms Now Available
In the event that you are unable to meet the traditional prerequisites for education, training, and/or supervised experience for obtaining a particular license under Chapter 501, due to COVID-19, you may be able to request a modification of the prerequisites under 22 TAC 463.14.
At its November 19, 2020 regular meeting, the Texas State Board of Examiners of Psychologists approved usage of ASPPB’s COVID-19 resource tools. These tools can assist applicant’s with documenting their non-traditional prerequisites for licensure for: education, practicum, internship, and post-doctoral experience. You can access these Optional COVID-19 Licensure Modification Forms, on the Board’s website. Please note that these forms do not replace any existing forms required for licensure under Chapter 501.
